On November 30, at the sitting of the NA Standing Committee on State and Legal Affairs the amendments and addenda being proposed to the law On the System of Whistle-blowing and to the co-laws.

The RA Deputy Minister of Justice Arpine Sargsyan reminded that the initiative is directed to the improvement of the system of whistle-blowing. The Deputy Minister voiced two key amendments: it is also proposed to the Human Rights Defender (HRD) to set a competent body, which will recruit the statistics received from the state bodies, which will be published on the website azdararir.am. The HRD has a toolset for decently organizing the protection of whistleblowers. Within the logic of the Criminal Procedure Code the HRD can apply to the body implementing the procedure for taking steps to provide the whistle-blower appropriate protection means. It is also designed to create a new kind of whistle-blowing – whistle-blowing to the public, which is aimed at the creating practical mechanisms in the fight against corruption.

The Government presented several proposals by editing the notion Whistle-blowing the public in the regime from the first to the second reading.

Arpine Sargsyan also submitted orally proposals, The Corruption Prevention Commission can exercise authority without having direct accessibility on the platform azdararir.am.

The RA Deputy Minister of Justice in the second reading presented the addenda and amendments to the law on Public Service and a number of other laws.

The adoption of the new regulations is conditioned by the necessity of clashing of interests between the persons holding public position and public servants, the incompatibility of demands and improvement of the existing legislative solutions on the gift institutes, as well as providing the fulfillment of the international obligations assumed by the Republic of Armenia. Let us remind that in case of violation of restrictions for receiving gifts administrative accountability was set for the persons holding public position and public servants.

According to Arpine Sargsyan, the Government presented two proposals in written form. It is proposed not to make subject of accounting the protocol gifts being given publicly by the foreign states, international organizations or other persons. It is also suggested to review the framework of the inter-connected persons. It is offered to foresee the function of the one responsible for the anti-corruption programmes in the position passport of the person holding concrete position in every structure and to have more systemized approach.

The addendum proposed in the Constitutional Law the Rules of Procedure of the National Assembly by the deputies Alkhas Ghazaryan, Vladimir Vardanyan and Arpine Davoyan was also debated in the second reading.

After taking an oath with the new regulation the deputies will sign under the text of the oath at the sitting of the National Assembly. Proposals were not presented after the first reading: the co-author of the draft Alkhas Ghazaryan informed about this.

The Government provides a norm by adding in the law on Regulation of the Administrative Legal Relations, by which the executive body will approve the exemplary form of the statute of the state institutions carrying out programmes functioning in the state administrative system bodies.

The RA Deputy Minister of Justice Armenuhi Harutyunyan presented the proposing regulation in the Committee.

The initiatives were endorsed by the Committee.
